- Abstract: This article discusses the criticism of the United States (US) on the WTO Appellate Body (AB), i.e. the AB becoming dysfunctional. It examines some of the proposals presented to overcome the current deadlock, including the feasibility of the terms of the ‘‘Multi-Party Interim Arbitration Arrangement Pursuant to Article 25 of the DSU’’. The article shows that there are reasonable arguments to sustain that AB’s findings and interpretations did not lead to judicial overreach or did not act to add or diminish Members rights and consistency arising from the application by both the Panels and the AB of the same rules to the same facts, regardless of the parties involved, is an important source of legitimacy for any adjudicating body. Nevertheless ,the US will continue to raise its systemic concerns with AB overreaching and press for WTO Members to take responsibility to ensure the WTO dispute settlement system (DSS) operates as intended and agreed in the Dispute Settlement Understanding (DSU). It concludes that the AB, the so-called ‘’crown jewel’’ of the WTO and the DSS seems to be inexorably part of the past and history.
