- Abstract: Ressalta a importância do princípio da precaução na relação entre o Direito e a ciência. Constata que a consolidação do Direito não pôs fim aos questionamentos éticos, persistindo a busca das soluções propostas pelo Comitê de Ética. Afirma que o Poder Judiciário contemporâneo encontra-se numa situação ôesquizofrênicaõ e que sua inadequação às exigências atuais justifica a existência de decisões judiciais totalmente discrepantes em casos semelhantes, bem como a descrença popular em relação à justiça, dentre outros problemas. Por fim, acredita que, nas hipóteses cujas limitações do conhecimento científico evocam o princípio da precaução, será necessário um grandeinvestimento social para divulgação popular dos meios e modelos da ciência, a fim de harmonizar a conflituosa relação entre Direito e saúde
